Conditions of Participation in Contests

  1. Scope
    1. The following conditions of participation (hereafter referred to as „Terms and Conditions“) apply forparticipation in all competitions organised by goodbeans GmbH (hereafter referred to as goodbeans), unless otherwise stated in the respective competition and its description.
    2. The Terms and Conditions applyin each situation as amended at the time of use. They apply complementaryto any particular conditions of a competition, if given. By taking part in the competition, the participant explicitly accepts the following conditions as well as the particular terms of thecompetition in question.
  2. Participation
    1. All natural persons who are 18 years of age are eligible to participate. Minors are, subject to appropriate legal regulations, eligible for participation in cases where goodbeans allows it andthe legal representative agrees to it. Excluded from participation are employees of goodbeans and of affiliated companies as well as potential cooperative partners and their family members. Participation in competitions in return for payment (as defined by the contest regulations of the statemedia authorities) is only allowed for participants of an age of 14 or older.
    2. Each participant can enter only in their own name and only once per competition. Potential winnings are non-transferable.
    3. Participation in competitions is, notwithstanding other ways to participate mentioned in the competitiondescription, possible through sending a sufficiently stamped postcard by mail. The postcard is to be directed to: goodbeans GmbH Competition „(Title)“ Winsstraße 62/63 10405 Berlin. For short-term competitions, such as when the winner is chosen during or shortly after a TV broadcast,participation by post is not possible due to time constraints.
    4. The participant is obligated to specify the title of the competition, the required answer if applicable, as well as their true name and address and possibly other personal data that is required for thedetermination of the winner and delivery of the possible prize.
    5. If the participation requires sending of materials (e.g. in case of arts and crafts competitions), the participant guarantees that he or she is the sole owner of all rights of use and exploitation to thematerial sent. With the sending of the materials, the participant agrees to grant goodbeans the ownership and comprehensive rights of use and exploitation of the materials sent, unless the participantdeclaresdisagreement with this practice in written form at the time of the sending of the materials. goodbeans shall not be held accountable for any material sent, notwithstanding liability for wilfulintent or gross negligence. After the closing of the competition, goodbeans is entitled to discard any sent material.
    6. Closing date for all submissions is the termination date of the participation period. If termination ofparticipation is a Sunday or an official holiday, the last working day (not Saturday) before the termination date applies.
  3. Execution and Prizes
    1. Determination of winners is executed by goodbeans, its employees, auxiliary persons or authorisedthird parties. goodbeans is not liable for slightly negligent behaviour by these persons in the process of determination of winners, notwithstanding liability for wilful intent or gross negligence.Legal recourse is excluded.
    2. For participation in competitions in return for payment (as defined by the contest regulations of the state media authorities), a disbursement of winnings for participants under the age of 14 is excluded.
    3. Determined winners will be notified via telephone, email, post or fax. Every notified winner isobligated to promptly inform goodbeans whether he or she accepts the prize. If goodbeans does not receive such information within a reasonable amount of time, the possibility to obtain the prizeexpires and goodbeans reserves the right to determine another winner and notify them accordingly. The originally determined winner has no right to make claims for compensation insofar. If goodbeans is aware of the address of a determined winner, goodbeans reserves the right to mail the prize along with the notification.
    4. A potential visual presentation of a prize in the competition description is not necessarily identicalto the actual item. Deviations, including but not limited to, the model, colour and features are possible.
    5. In principle, the winnings consist exclusively of prize, value and amount specified by goodbeans.In case of doubt, postal charges for sending a prize abroad are not included. Potential consequential costs that may follow the use of the winnings are only included if explicitly stated in the competition. goodbeans is not liable for damage that might occur to the participant or a third party by theacceptance and/or use of the prize, notwithstanding liability for wilful intent or gross negligence.
    6. Cash payment and exchange of prizes are excluded.If a prize cannot be claimed by the winner (e.g. due to timing), it expires without substitution. Prizes are non-transferable.
  4. Premature Termination, Exclusion
    1. goodbeans reserves the right to terminate or close the competition at any time without advancenotice and without stating any reasons. This applies in particular if a competition cannot be run or continued due to technical or legal reasons. In this case, the participants shall not be entitled tomake any claims against goodbeans.
    2. goodbeans reserves the right to decline entry of participants in a competition in particular if the Terms and Conditions have been violated, or if manipulative or other dishonest means have been employed.goodbeans can express such exclusion retroactively, deprive of the prizes and reclaim them.
  5. Data Protection
    1. goodbeans respects the privacy of the participants and is committed to data protection. However, it is inevitable for the execution of the competition that the user provides certain personal data.Personal data includes for example name, address and age of the user, without the knowledge of which it would not be possible to determine winners. By participating, the participant agrees to the storage anduse of their personal data for the execution of the competition. goodbeans commits to handling personal data confidentially and will use this information exclusively according to the correspondingstrict legal regulations.     2. goodbeans reserves the right to publish the name of the winner. The winner hereby agrees to the publication, unless such disclosure is disagreed with upon participation.
    3. goodbeans would like to point out that it is obligated to create a record of all personal dataprovided in the entry. goodbeans is also obligated to store the data for a certain amount of time after the conclusion of the competition and, if applicable, to disclose it to appropriate regulatoryauthorities. Every goodbeans competition participant agrees to this use and storage of data.
  6. Other
    1. For the execution of competitions through goodbeans, the laws of the Federal Republic of Germany shallapply exclusively. Sole place of jurisdiction, to the extent allowed by law, is Cologne. Should any provision of the Terms and Conditions mentioned above be or become either void or unenforceable, theremaining provisions shall remain in effect.
